Terms and Conditions of Service
“Allure Transportation” appreciates your business. By being specific with our requirements we can help assure you and your guests that your event will be successful.
Client Agreement: By reserving your vehicle you are automatically agreeing to all of the following terms and conditions of service, whether a contract is in-hand or not. Verbal, written or electronic, the following terms and conditions of service are considered binding by all parties involved.
Full Payment is required by the date of service. We do not extend credit.
Cancellations: All reservations, “jobs” (charters and transfers) must be cancelled at least 7 days prior to service date to avoid the full charge. NO REFUNDS are given for any cancellations within the seven day window prior to any event. A cancellation may be rebooked for a future trip (identical in nature, based on availability) if the reservation/ “job” cancellation occurs within the seven day window of a reservation/”job”. An administrative fees of $50 (fifty dollars) will be charged to your credit card for these cancellation changes in addition to any and all fees and outstanding balances for the original vehicle/event booking.
Cancellations by Allure Transportation: Allure Transportation may cancel a “job” for any reason (mechanical difficulties or otherwise) and the total cost of the “job” will be credited for a future reservation of equal value to the existing “job” as contracted. Allure Transportation reserves the right to subcontract any “job” as contracted, in part or in full, to an alternate carrier. This includes the substitution of the contracted vehicle to one of equal value or greater in order to complete the “job”.
Billing: Your time starts at the arranged pick-up time at the first location and ends at the last drop-off location in which the last person leaves the vehicle. Overtime charges begin at the “end-time” scheduled by the client. Overtime charges stop when the last person leaves the vehicle.
Overtime Billing: Extra hours/Overtime hours are billed on an hourly rate basis. Extra hours/Overtime hours may or may not be available and are not guaranteed. The client agrees to allow overtime charges for overtime services on the same credit card used by the client for deposit and payment – during our normal business hours of 9 am – 7 pm (CST). After normal business hours, your credit card will be swiped or credit card information obtained in the vehicle before these extra hours begin. Failure to successfully “run” your credit card will result in immediate termination of the “job” and no Extra/Overtime hours will be provided to the client.
Overtime Grace Period: You will be given a ten minute grace period prior to being billed for Extra/Overtime hours. For example, 5 hours and 11 minutes will be billed as 6 hours. Please plan your event so that the final drop-off point falls within your reserved time.
Overtime Availability: A daytime “job” may not be able to be extended if the vehicle in use has been reserved and scheduled for an evening “job”, thus preventing use of the vehicle beyond the scheduled “end time”. Please try to determine this ahead of time and make your plans accordingly. Overtime on an evening “job” is usually not a problem, although we cannot guarantee any overtime.Cash “Jobs”: Allure Shuttle will not accept any cash payments on the day of your event. Our drivers are allowed to accept cash tips. (No driver solicitation for any tip is permitted by Allure Transportation). Allure Transportation will accept cash payment or bank certified checks up to 48 hours prior to any engagement. These monies may be brought to our offices with prior arrangement. A credit card must always be on file with our office and will remain a source for collection for any unpaid balances, damages, and/or cleaning (see “Damages” and “Vehicle cleaning”).Damage: The client is responsible for all damages and guest damages. Damages will be charges at 125% of the repair costs. Please remember that vehicle damage leads to downtime of our vehicle as well staff and fuel costs to get the vehicle to repair. Repairs are at the sole discretion of Allure Transportation. Repairs will be done in such a fashion as to restore the vehicle to the same intact and working condition as was prior to the damage. All repairs and or replacement (factory specific) will also include labor and installation charges (including any factory installation fees). Seat punctures, audio speaker damage, drink holders, arm rests, television monitors, lighting control panels, and audio control panels are very expensive items to repair. Please respect our vehicles.
Cleaning Charge: Extra charges may be imposed for “excessive mess” by passengers – including but not limited to excessive trash, beer cans, and bottles. Photo documentation will be made in conjunction with such charges. Please help us by removing “excessive trash” at the end of your event. We have a trash bin and will provide trash bags. We will collect all plastic cups and soda bottles provided by Allure Transportation. We will collect all used glassware provided by Allure Transportation. “Excessive” food or drink spills will incur a $250. Fee for cleaning. Gum on our seats or in our carpets will also incur a $250. Fee for cleaning.
Vomit: Automatic $350. Fee for cleaning. This fee is per incident. NO EXCEPTIONS. This charge will be billed to the credit card of the client who contracted the “job”. Professional cleaning, upholstery cleaning, and carpet cleaning is expensive.
SMOKING IS NOT ALLOWED in any of our vehicles. Smoking 1st offense: $250. Fee. 2nd offense: Initial fee and termination of the “job”. This is at the sole discretion of our driver or any of our staff. NO EXCEPTIONS. Vapor cigarettes are NOT ALLOWED.
Coolers: Personal coolers are NO LONGER allowed inside our vehicles. Coolers tend to scratch the floor, leather seats, and bar areas during loading and unloading. Your cooler is allowed in the trunk area. Please inform your driver if you have items that you would like placed in our vehicle’s coolers (cooler storage area varies per vehicle).
Glassware: There will be a $25. Fee “per glass”. This charge includes any broken or missing glasses. Our glassware is ordered from the vehicle manufacturer to custom fix the bar and glassware holders. These charges do not apply to any plastic cups supplied by Allure Transportation.
Seating: Seating is essential at all times while the vehicle is in motion. Seatbelts are available for each and every passenger in a contracted vehicle. Allure Transportation is not responsible for injuries to guests who are not seated and not wearing seat belts during transit. Allure Transportation will not permit any vehicle to be overloaded and will always have the number of passengers limited to seatbelt availability. Your driver will confirm the maximum number of passengers permitted in the vehicle. Any additional passengers above seat belt availability will NOT be permitted. Please do not exceed the maximum number of passengers allowed in a specific vehicle. It is both dangerous and NOT allowed by state and federal regulators.
Unfavorable Conditions: Do not ask the driver to drive the vehicle on muddy roads, torn up roads, or go up or down steep driveways. It is the driver’s discretion to refuse operation of our vehicle in any road hazard or condition of the nature described. This will avoid danger to our passengers as well as damage to our vehicles. It will also avoid any police citations to our driver, our company, or our clients.
Driver’s Responsibility/Chauffeur’s Responsibility: The driver/chauffeur must act in a responsible fashion to care for your safety and the safety of your guests. As well, our chauffeur’s are responsible to safeguard their vehicles. Vehicles will never be left unattended during your time of hire. Your chauffeur is NOT allowed to party with you.
Judgement of Driver/Chauffeur: It is the sole judgement of the driver/chauffeur to determine that the behavior of the client or any guest(s) is out of control, obnoxious, disrespectful, unsafe, illegal, dangerous, or irresponsible. This behavior applies to both human life and property. Illegal substances and fire arms are NOT permitted in any of our vehicles. A driver can and will terminate a “job” on the spot and order all occupants out of the vehicle if he or she feels necessary. A driver can and will call the authorities if he or she feels necessary. A driver may or may not issue a warning before he or she takes action. If this happens, you will NOT receive a refund for any monies whatsoever.
Delays: Allure Transportation will not be held liable for delays due to weather, road conditions, traffic, mechanical conditions, driver’s illness, or any other condition beyond our control. Allure Transportation will not be held responsible in any way for lodging, food costs, or other expenses due to any delay. If you are on a time schedule, please reserve your vehicle accordingly. Your driver will NOT speed to your event or the next stop. Our drivers will only go as fast as the speed limit allows.
Allure Transportation will not be held liable for any “pick-up” delays if there is a miscommunication with our driver and/or the client’s arrival at a pick-up location is delayed. Please be aware that our drivers may have to move our vehicle from the arranged pick-up location if the client’s arrival to that location is delayed. Our drivers must act in compliance with local parking ordinances and other posted ordinances. Our drivers must act in compliance with local authorities. Please understand that it takes time to “circle around” any given location and that traffic patterns may preclude our drivers from returning to the pick-up location for that period of time required to “circle around”.
Breakdowns: Allure Transportation will not be held liable for any delays due to mechanical conditions. As well, Allure Transportation will not be held liable if such mechanical conditions should cause the vehicle to cease to function resulting in a “vehicle breakdown”. Any condition of such mechanical nature, whether under the hood, tire related, or otherwise will require our driver to stop the vehicle from being used. Vehicle breakdowns as such are to be determined by the driver, and/or the Company, and/or a professional mechanic certified to repair such vehicle. Some vehicle situations as such are regulated by state and federal authorities and require the vehicle to be “shut down from operation” for passenger safety. Allure Transportation will not be held responsible in any way for lodging, food costs, or other expenses due to any mechanical breakdowns. Allure Transportation will make every effort to obtain another vehicle in order to complete the event booking in a timely fashion. If such replacement vehicle is not able to be obtained, the total cost of the “job” will be credited for a future reservation (identical in nature, based on availability) of equal value to the existing “job” as contracted.
Surprise Arrivals: If the arrival of our vehicle is a “surprise”, please make sure to indicate that on the reservation. Allure Transportation will do everything we can to “keep your surprise” but will not be held responsible nor liable in any way if the “surprise” does NOT work out as planned.
Alcohol: Allure Transportation will NOT provide any alcoholic beverages. We will provide glassware or plastic ware, soft drinks, water, and ice according to the type of event booked (see charter rate, transfer rate). If there are any passengers under 21 years of age, we will ask you to provide a designated person “designee” (see below) who will be legally responsible for all minors and will remain with the vehicle until all such minors have exited the vehicle.
Minors: For minors traveling in our vehicles WITHOUT the presence of an adult (person above the age of 25 years old) traveling in our vehicle with the minor(s). A designated person “designee” (see below) must sign a document of legal responsibility for the conduct and behavior of the minor(s) using our vehicle. Taking this responsibility and signing a letter of legal responsibility will obligate the “designee” to all terms of the client’s contract including but not limited to responsibility for all minors in their behavior, care of vehicles, illegal use of alcohol, and/or use of illegal substances.
Designee Requirements and Obligations:
A) A designee must be 25 years of age or older and shall be present whenever persons under 21 years of age – who are not accompanied by a parent or legal guardian – are being transported. For minors traveling WITHOUT the presence of an adult, the designee must sign a separate document of legal responsibility for the conduct and behavior of the minor(s) using our vehicle.
B) The designee shall make reasonable efforts to ensure compliance with all laws prohibiting the consumption of alcoholic beverages by persons under 21 years of age who are members of the party and are not accompanied by a parent or legal guardian.
C) The designee shall check the identification of all passengers to determine who is under 21 years of age and shall read a statement (see below) to each passenger in the party who is under 21 years of age. The driver shall not commence transport until the designee has verified with the driver that the designee has checked the identifications of all passengers and read the statement. If passengers are picked up at more than one location, the driver shall not commence transport to the subsequent location until the designee has verified with the driver that the designee has checked the identifications of all passengers boarding the vehicle at that location and has read the statement to all passengers boarding the vehicle at that location.
D) The designee shall notify the driver of the vehicle, at any time during the trip, that a passenger in their party who is under 21 years of age is consuming or has consumed alcoholic beverages.
E) The designee shall be responsible for any reasonably foreseeable personal injury or property damage that is proximately caused by consumption of alcoholic beverages by a person under 21 years of age while traveling with our service if the designee knew or reasonably should have known that a person under 21 years of age has consumed an alcoholic beverage while being transported with our service.
F) If a trip is terminated because of the consumption of alcoholic beverages by a person under 21 years of age who is a member of their party, the designee’s responsibility for that minor shall continue until that person who is under 21 years of age is returned safely to his or her home or entrusted into the care of his or her parent or legal guardian or taken to a location reasonably believed to be safer than his or her home.
G) Designee Statement: “The legal drinking age in Louisiana, Alabama, Mississippi, and Florida is 21 years of age. You are below the legal drinking age. You are NOT allowed to drink any alcoholic beverages while in this vehicle. I have signed a legal document that I am fully responsible for your behavior and actions while in this vehicle. Please do NOT drink any alcoholic beverages while in this vehicle. If you do so, the entire trip may be canceled and we may all be asked to get out of the vehicle. The driver may call the police if he even thinks you had one drink.”
Safety: Allure Transportation prefers NOT to drop a client off at a vehicle when the client has consumed alcohol. Please make arrangements that no one in your party is put in a position of potentially driving under the influence. Allure Transportation does NOT serve any alcoholic beverages. Allure Transportation assumes NO liability for passenger safety once the passenger has disembarked from our vehicle.
Pass-outs: If someone in your party passes our due to excessive alcoholic consumption, we WILL vacate this person from the vehicle. If this passenger is in any apparent medical distress our driver will proceed directly to the nearest hospital and all passengers will be vacated from the vehicle. Our drivers have NO medical training. Please do NOT allow your friends to ruin your evening.
Behavior and Conduct – on the part of the passenger:
Lewd and lascivious acts deemed inappropriate or offensive to our driver will result in our driver’s discretion to terminate the “job” immediately. A driver may or may not issue a warning before he or she takes action. In addition, a $250. Fee will be charged to the credit card to sanitize the vehicle.
If Allure Transportation, employees, or contracted workers feel that a passenger is loud, disturbing, rude, unruly, dangerous, or disruptive to other passengers or the driver, this person(s) may be removed from the vehicle at a safe location and/or authorities called. A driver may or may not issue a warning before he or she takes action. Your driver will nor purchase cigarettes or alcohol for any of our clients or members of their party.
The client, by reserving the vehicle and contracting with Allure Transportation, assumes any and all risks of property damage to the vehicle resulting from a passenger conduct or behavior issue, and releases and holds harmless Allure Transportation from any and all liability for personal injury and/or property damage resulting from a passenger conduct or behavior issue.
Contraband: Allure Transportation will refuse to transport anyone in possession of a weapon or illegal substance. Authorities will be contacted. Possession of illegal drugs, sale of illegal drugs, or use of illegal drugs by anyone in our vehicles is strictly prohibited. If a driver observes drugs, he will pull the limousine off the road. The vehicle will be vacated immediately. You will NOT receive a refund. All items and bags are subject to be searched.
Weapons: Weapons are NOT allowed in any of our vehicles. Even if you have a CCW permit, weapons of any kind are NOT allowed. All items and bags are subject to be searched.
Lost Items: Please make sure you have left nothing in our vehicle at the end of the “job”. This is your responsibility and we will accept absolutely no liability or responsibility for anything you may have left behind. If you do leave something in our vehicle, we will try our best and make every effort to recover the lost item. If we do find this item, we will notify you. Please make arrangements to come by our office to pick up your “lost and found” item.
Theft: Please take all valuables out of the vehicle when the vehicle makes a stop and you depart the vehicle. Our drivers will make every effort to guard the vehicle and lock the doors when the vehicle is parked. However, due to the nature of passengers getting into or out of the vehicle at various times, we cannot guarantee the safety of your valuables. Allure Transportation will not be held liable or accountable in any way for lost or missing or stolen items. Some of our vehicles have storage compartments for your convenience. These compartments (with or without locks) are not to be considered “secure”. Please take your valuables with you as you depart any of our vehicles.
Stolen Items from our vehicles: Any items stolen from our vehicles will result in charges for full (factory specific) replacement being billed to the client. These fees will also include any and all installation fees, factory installation fees, and all labor fees for installation of stolen item replacement(s) such as (but not limited to) televisions, audio equipment, bar items, and television remote controls.
Media: All entertainment CD’s, DVD’s, MP3’s are to be provided by the client. Allure Transportation is NOT responsible for any lost, missing, or damaged items of this nature. TV remote controls are the property of Allure Transportation. Any of our missing items will be billed to the client for full factory specific replacement.
Temperature: We will make every effort to make our clients comfortable. Our vehicles are all air conditioned and heated. Allure Transportation will not be held accountable or responsible for temperatures exceeding 80 degrees or any other extreme weather conditions.
Parking Arrangements: If you would like our vehicle parked at a particular venue, house of worship, reception facility, etc. it will be the client’s responsibility to make those arrangements and see that a parking space for our vehicles is reserved is some manner. We will be glad to provide you with the specific dimensions of any of our vehicles. If parking is not prearranged, the vehicle may have to be moved and parked somewhere nearby in order to comply with local parking ordinances.
It is the drivers’ discretion to move any vehicle if he or she feels that a waiting area is unsafe or not in compliance with local ordinance. It will be the client’s responsibility to communicate directly and clearly with your driver. Please be specific with our drivers so that they will be in the right place at the correct time. Please understand that it takes time to “circle around” any given location and that traffic patterns, parking regulations, and police regulation may preclude our drivers from being exactly where you want them, when you want them.
Directions: Allure Transportation will request that you send us (by contract or email or fax) the names, addresses (if possible), and times for your transportation needs. Please notify us of all “places and times” as soon as possible. Please notify us of any updates, changes, or additions to your hire as soon as possible. It is very difficult for us to make changes within a 48 hour window of any given event. We have GPS systems in all of our vehicles and with all of our driver’s phones. If you would like to give our drivers any verbal directions, please give the driver plenty of notice for stops and turns. Our large vehicles need time and space to respond and maneuver. We also try to avoid areas where it is difficult to “back out” these larger vehicles.
Decorations: Our clients are not permitted to decorate the vehicle in any way, fashion, or form. Damages incurred from the use of any unauthorized decorations will be the client’s responsibility for any and all damages resulting as such.
Transfer Rates: These rates are based on a point “A” location to point “B” location transfer for transportation in the greater New Orleans metropolitan area. There will be an additional charge for any transfers out of the greater New Orleans metropolitan area and for any additional stops. Our fees are inclusive of all service charges. Parking and tolls are included. Rates may change due to special events and holidays. Our drivers and vehicles do not wait for a client once dropped off at the assigned destination with this type of booking.
Charter Rates: Our drivers and vehicles remain in the vicinity (see “parking”) for a client once dropped off at the assigned location. All charters are subject to a 3 hour minimum (Sunday – Thursday) and a 5 hour minimum on weekends (Friday, Saturday). There will be an additional charge for any charters out of the greater New Orleans metropolitan area. Our fees are inclusive of all service charges. Parking and tolls are included. Rates may change due to special events and holidays. All charters include complimentary soft drinks, water, and ice.
Emergency exits: Emergency exit windows and emergency roof exits are provided in compliance with federal regulations. These exits are clearly marked and or lighted. Standing or hanging out of emergency moon-roof exits is strictly prohibited. Hanging out of any windows or doors is strictly prohibited. Vehicles are provided with fire extinguishers, medical kits, and safety reflectors as prescribed by federal and state regulators.
Questions/Problems: We welcome our client’s calls and emails for any questions and or problems. We will try to answer your questions to the best of our ability. We will address any problems and try to resolve them to the best of our ability in a professional and respectful fashion.
Confirmations: We kindly request that you call and reconfirm all times and location addresses 48 hours before your event. As well, our office and/or our drivers will try to contact you in order reconfirm your “job” and answer any last minute questions. It is difficult and may be impossible to make any changes to your vehicle/event booking less than 48 hours before any “job”.
